Everything You Need to Know About Streamtime's License Agreement

A simple guide to our License Agreement. To be used as a guide only.

Streamtime's License Agreement is a legal document that all Streamtime users must agree to in order to use our software. This document outlines the rights and responsibilities of both Streamtime and our users. In this article, we will explain the contents of the License Agreement in simple terms and provide instructions on how to contact us if you have any questions.

In this article, Streamtime Classic means our legacy app that runs as a separate app on your desktop, and Streamtime.net means our current app that you run through your browser.


License

Streamtime Classic

  • You can only install Streamtime Classic on the number of devices that you have licenses for.. So, if you own 3 licenses, you may install Streamtime Classic on 3 separate computers.

  • Streamtime Classic licenses are only valid for a set period. You have to renew your license if you want to keep using it after that.

  • Don't share your license key with anyone else - it's just for you.

  • All users of Streamtime Classic must follow our license agreement. You are responsible for informing them of this policy.

  • You'll be responsible for installation costs.

Streamtime.net

  • You will be issued a number of user licenses per your arrangement. Each license will provide access to Streamtime.

  • Every user is responsible for using Streamtime in alignment with our license agreement. You must make sure that all users are aware of this fact.

Ownership

You own all the data, information and media that you record in Streamtime. You made it after all 🧐, but Streamtime owns the software.


Restrictions

  • We worked hard to design and build Streamtime, and it is our intellectual property. So don't be that person and reverse engineer, disassemble or anything that interferes with our copyright without our permission.

  • Also, do not modify, sell, rent, lease, loan, or distribute Streamtime without our permission.

  • You cannot change Streamtime or make it into something else.

  • Do not remove or reproduce any copyright notices or proprietary legends.

  • Do not give anyone your login information unless they are meant to use the program according to the license agreement.

  • Streamtime is a project management app for creatives. So it's not designed for things like running nuclear facilities, aircraft navigation, communications systems, air traffic control or anything where Streamtime's failure could cause death, personal injury or severe physical or environmental damage. Because seriously… we’d rather the world be a better place than no place!

  • Without our prior written consent, you may not transfer or assign any portion of the license agreement to anyone else.


Maintenance

  • Upgrades are new versions of a product. They might be a little bit better than the old version or have some new features.

  • An update refers to a software update that contains bug fixes, compatibility updates to maintain compliance with specifications and standards, and updates to interoperate with specific standards.

  • Our license agreement also gives you the right to use any Maintenance Software that is released while this Agreement is in place.

  • We will create and release software products when they are finished. We don't promise to make it available at any particular time.

Streamtime Classic

We will only support Streamtime Classic and not third-party software, like FileMaker Pro or FileMaker Pro Server, unless it is part of the purchase agreement in writing.

Streamtime.net

Streamtime.net is hosted on the internet, which means that everyone gets the same updates and maintenance at the same time. On average, we release new updates and improvements every month, but sometimes as frequently as every two weeks.


Term & Termination

Renewal

You’re in complete control of your subscription period and when it renews. You can manage this from your account settings within Streamtime.

Breaches

  • We will send you written notice if you breach the license agreement. This includes nonpayment of accounts.

  • If you haven't fixed the breach after ten days, we will send you another written notice letting you know that we are terminating your access to Streamtime.

  • After receiving notification that we have terminated your access, you must stop using Streamtime immediately.

  • To be fair we will hold ourselves to the same rule. If You are unable to use the solution for more than ten (10) days you have every right to cancel (see below). That said, our uptime for streamtime.net since April 2016 has been 99.9%. You can check our uptime here.

We are committed to providing our clients with the best possible service. That's why we don't want to issue breach notices or cancel agreements. We would only do so as a last resort. If you have any issues or are experiencing any hardship, please talk to us. We are more than happy to make any reasonable accommodation for you. Your success is our success. Streamtime is here to help you succeed. So please, don't hesitate to reach out if you need anything. We're always happy to help.

Termination

Once the license agreement is terminated for any reason, you must stop using, installing or copying Streamtime. All fees, including pre-paid fees, are still payable, and you are still liable for them.

Survival

Even after termination, the License, Restrictions, Term & Termination, Limited Warranty, Limitation of Remedies and Damages, Audit and Government End Users parts of the licence agreement still apply.


Limited Warranty

  • We promise that Streamtime will work according to the published specifications for ninety (90) days from the date of this agreement.

  • If we do not meet the warranty, our only responsibility is to repair or replace the software.

  • There are no refunds available.

  • This is the only warranty that Streamtime provides. They do not have any other warranties, including but not limited to implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title or non-interference with Your enjoyment of the Software.

  • Streamtime does not guarantee that the software will meet your requirements or work without errors.


Limitation of Remedies and Damages

  • Streamtime and its licensors and contractors will not pay you back, give you more money, or help you if:

    • You cannot use the software and/or our services

    • We stop offering any or all of our services

    • Someone unauthorized accesses, changes, deletes, destroys, damages, or loses your content or other data


Audit

  • Streamtime or an independent third party may audit the company once per year to confirm that they are in compliance with the Agreement.

  • The company will provide a knowledgeable employee to assist in such audit.

  • If the audit reveals that the company has underpaid amounts owing, they will promptly pay Streamtime such past due amounts.

  • If any underpaid amount exceeds 10% of what was owed, the company will also reimburse Streamtime for any direct out-of-pocket expenses incurred while conducting said audit.


Support

  • Streamtime will provide technical support services to paying subscribers via email or digital chat/video call. This service is free for subscribers.

  • Streamtime may offer consulting services including, but not limited to, advice on workflow, business or project management, or full team training for a fee.

  • We pride ourselves on our customer service and support. We use Intercom, an email and chat-based system to log and ticket issues.

  • Social media is used for public communications only.

  • Streamtime will commence work on the issue at the stated timeline.

  • If the problem cannot be resolved within the timeline, you will be given an estimated time/date of resolution.

  • Streamtime has the right to limit each support call to half an hour and to one incident only. They may also terminate service if a customer is using it in an irregular or abusive manner.

  • Worldwide Support is limited to a term of the subscription and available between 11 pm Sunday and 5 pm Friday GMT, with occasional deviations due to maintenance or holidays.

Streamtime Classic

  • Streamtime Classic software upgrades require the system to be shut down and can be performed by the end-user or sent to Streamtime.

  • Updates are applied, and the system is sent back. The turnaround time for the upgrade will be agreed upon with you in advance.

  • Software upgrades of the underlying database platform (FileMaker Pro and FileMaker Pro Server) or other third-party software products deployed within Streamtime are not included unless agreed in writing at the time of purchase.

  • Support Services for Streamtime Classic exclude the following:

    • The correction of errors or defects in the Software caused by the operation of the Software in a manner other than that specified or intended by Streamtime

    • The correction of errors or defects in the Software caused by any modification, revision, variation, translation, or alteration of the not authorized by Streamtime

    • The correction of errors or defects in the Software caused by the use of computer programs not approved by Streamtime


Hosting Services

  • Streamtime may end or change any of its hosting services at any time. This includes removing features or functionality of the hosting services.

  • Streamtime will let you know if there are any changes to the hosting services.

  • Streamtime may use different companies to provide hosting services to you, and it may change which companies it uses from time to time.

  • You agree to follow any terms of service set by the company that provides hosting services for Streamtime. This means that you will have to pay the company back if you break any rules.


Export Law Assurances

Streamtime is committed to complying with US and Australian export control laws and regulations. We cannot provide Streamtime products and services to anyone on the US Treasury Department's list of Specially Designated Nationals or the US Department of Commerce's Denied Person List or Entity List. We also cannot provide Streamtime products and services to anyone in a US-embargoed country.


Government End Users

All software provided to the U.S. government pursuant to solicitations issued before December 1, 1995 is provided with restricted rights as provided for in FAR, 48 CFR 52.227-14 (June 1987) or DFAR, 48 CFR 252-227-7013 (October 1988), as applicable.


General Terms

  • Our License agreement will be followed and enforced under Australian law.

  • Any legal issues that come up from our License agreement can be dealt with in any court that has the power to do so in Australia.

  • You agree to let the Australian Courts make decisions about our license agreement.

  • Our License Agreement is the only agreement between us regarding the software licensed under these terms.

  • Our License Agreement is more important than any other agreements about this subject matter, whether those other agreements happened before or at the same time as this one.

  • No changes to our license agreement will be official unless it is written down and signed by Streamtime.


Arrears

If you owe Streamtime money for services like training, support, pipeline, or subscription, we have the right to end your service until you pay the money back.


Terms and Conditions

We can change our license agreement at any time. We will post the changes on our website. This is enough notice to you that we have changed the terms.


Activation

Streamtime software is activated via the internet. You need to have an open internet connection during activation. Activation frequency is displayed on the home screen of Streamtime. Activation is required to allow continued use of the software.


Promotions and Special Offers

Streamtime may offer discounts and special offers to new and existing customers. These offers are up to us and maybe for only certain customers.

Referral Program

Streamtime has a referral program for subscribers. We will give you a reward if you refer someone who signs up for a paid subscription. The value of the reward may vary. If we can't give you the reward, we will give you extra time on your subscription. You can find more information about the program by selecting the "Refer a Friend" link in the menu when you are logged in to your subscription at Streamtime.net.
